TRANSFER PETITION (CIVIL) NO. 127 OF 2024

O R D E R

1. Heard Mr. Swaroopananda Mishra, learned counsel appearing for

the petitioner (wife).

2. The counsel refers to the office report to point out that

although notice was duly served on the respondent (husband), he has

failed to enter his appearance.

3. It is then pointed out that the claim for maintenance filed by

the petitioner under Section 125 Cr.P.C. and also her complaint

under the Domestic Violence Act are pending before the Courts at

Bilaspur where the respondent is required to contest.

4. Having considered the above, we allow the transfer petition.

The HMA No. 876 of 2023 titled “Prince Anand v. Mohini Bansal”,

pending before the Ld. Additional District and Sessions Judge, Camp

Court at Naraingarh, Ambala, Haryana is directed to be transferred

to the Principal Judge, Family Court, Bilaspur, Himachal Pradesh.

5. Records of the case would be immediately transferred to the

transferee court.

6. The parties are directed to appear, either in person or

through an authorized representative before the transferee court.

However, in case there is non-appearance, court notice would be

issued to the defaulting party.

7. The transferee court would decide the matter expeditiously.

8. Pending application(s), if any, shall stand closed.
