Heard the learned senior counsel appearing

for the parties.

This is the petitioner, which is the

prosecuting agency that has come forward to file

this Transfer Petition seeking transfer of the

Sessions Case No.1694/2023 from the file of

Principal District and Sessions Judge, Srinagar

to the Principal District and Sessions Judge,

Chandigarh.

Learned counsel appearing for the petitioner

submits that two of the accused are lawyers and

six of them are doctors.

It is a case where investigation was carried out

by the State police earlier and thereafter,

transferred to the CBI. The witnesses have also

deposed to the effect that they were pressurized to

give evidence even against the police officers.

Learned senior counsel appearing for the

respondent submits that it is the petitioner who

slept over the matter in not prosecuting and

proceeding with the trial, notwithstanding the

orders passed by the High Court.

The fact that few of the accused are lawyers is

not in dispute. They are practitioners before a

District Court, though not before the Jurisdictional

court.
