O R D E R
1. Delay condoned.
2. The instant appeals are directed against an interim
order dated 25.08.2025 passed by the National Green
Tribunal, Western Zone Bench, Pune. Vide the impugned
order, the Tribunal has condoned the delay of 151 days on
the part of the respondent no.1 in filing the appeal and
thereafter issued an interim direction staying the
demolition of the dwelling unit of the said respondent.
3. The appellant’s case is that his ancestral house in
Survey No.119/3 situated in Tembwada, Morjim, Pernem, Goa
and another property, i.e., Survey No.116/35 in village
Morjim, Pernem, Goa, both fall within the CRZ area. On
this premise, the appellant asserts that the construction
raised by respondent no.1 is illegal, being in violation
of the CRZ Notification of 2011.
4. Since the main case filed by respondent no.1 is
still pending before the Tribunal, we are not inclined to
entertain these appeals at this stage. However, having
regard to the nature of the dispute, we direct the
Tribunal to decide the pending appeal at the earliest and
preferably within a period of two months. It is clarified
