Our attention is drawn to paragraph 65 of the impugned
judgment and it is submitted that the ratio in N.V. International
v. State of Assam1 has been applied, notwithstanding the fact that
N.V. International (supra) has been overruled in Government of
Maharashtra (Water Resources Department) v. M/s. Borse Brothers
