1. Leave granted.
2. The appellant was arrested on 06.07.2019 in connection
with FIR No.153/2019 registered at Bazar Peth Police Station,
Kalyan [West], Distt. Thane, Mumbai filed under Section 302/34
of the Indian Penal Code, 1860, 4/25 of the Arms Act, 1959 and
37(1)/135 of the Bombay Police Act, 1951.
3. Heard the learned counsel appearing for the parties.
4. Having considered the matter in detail and taking note of
the fact that the appellant has already undergone
incarceration of more than 5 years and the fact that there is
no likelihood of the trial being concluded in near future, we
consider it appropriate to release the appellant on bail

subject to such terms and conditions as may be imposed by the
Trial Court.
5. The appeal is allowed accordingly.
