O R D E R
Upon hearing the learned counsel appearing for
the applicant, the application for recall of order
dated 23.10.2024 is allowed.
However, we are not inclined to interfere with
the order passed, notwithstanding the submission
made by learned counsel appearing for the
applicant/husband that there is material suppression
on behalf of the petitioner/wife. Even assuming the
complaint given by the petitioner/wife under Section
498A of the Indian Penal Code is dismissed, the same
will not stand in the way of her right to seek
transfer, as this Court has to see the convenience
of the wife as against the husband. However, we
permit the applicant/husband to appear through

virtual mode, unless his physical appearance is
required by the trial Court.
The Miscellaneous Application is disposed of
with the aforesaid liberty.
