The record of proceedings reveal that notices were directed to

be issued to the respondents and the service upon them was complete

but even then no one had put in appearance. Therefore, this Court

by previous order dated 03.09.2024 had directed to proceed ex parte

against them.

Today also, when the case is called out, no one has appeared

for the respondents.

We have heard the learned counsel for the appellants on

merits.

Leave granted.

The challenge in these appeals is to the order dated

03.11.2022 and the subsequent order dated 17.01.2023. The writ

appeal was decided and subsequent to it the application for recall

of the said order on the ground that it was decided without hearing

the learned counsel for the appellants was rejected by the High

Court.

The submission of the learned counsel for the appellants is

that the writ appeal was posted for hearing on 27.10.2022 before

the High Court on which date, there was a call for strike by the

Orissa High Court Bar Association and therefore, their counsel

could not appear but even then the matter was taken up and decided

by the High Court. ...
