1. The petitioner has filed the petition under Section 25
of the Code of Civil Procedure, 1908 before this Court
seeking transfer of Case bearing Matrimonial Suit No. 1620
of 2025 titled as “Ashutosh Nayak Vs. Jingyansha Mishra”
pending before the 2nd Additional District Judge,
Barrackpore, West Bengal to the Family Court at
Bhubaneshwar, Odisha.
2. Vide order dated 06.11.2025, by the consent of the
parties, the matter was referred to Supreme Court
Mediation Centre. The Mediation Report dated 16.01.2026
indicates that the mediation between the parties has
failed.
3. Having heard learned counsel appearing for the parties
and taking into consideration the grounds taken in the
transfer petition, we allow the transfer petition and
direct the transfer of case bearing Matrimonial Suit No.
1620 of 2025 titled as “Ashutosh Nayak Vs. Jingyansha
Mishra” from the 2nd Additional District Judge,
Barrackpore, West Bengal to the Family Court at
Bhubaneshwar, Odisha.

4. Let the record of the case be transferred without
delay.
5. A copy of this order be sent to the concerned court
for compliance.
