O R D E R
This Court, vide order dated 2nd November, 2023
passed in Civil Appeal No. 4710 of 2023, had directed
the applicant-appellant to deposit 50% of the claimed
amount (Rs. 42.5 lacs) with the Trial Court within a
period of six weeks.
Learned counsel for the applicant-appellant
has filed an application ( IA No.251917/2023) seeking
extension of time of eight weeks for deposit of the
said amount.

Though there is strong opposition from the other
side to the said application for extension of time,
considering the facts and circumstances of the case,
we grant time to deposit the said amount till 31st
December, 2023 and to file proof thereof in the
Registry.
In case the said deposit is not made by the
said date with the Trial Court and proof of deposit
is not filed before this Court, the order dated 2nd
November, 2023 will stand automatically withdrawn and
the civil appeal shall stand dismissed.
Subject to above such deposit, list the matter
on 3rd January, 2024 along with its status report.
