Heard learned senior counsel appearing for the
appellant.
We have perused the impugned judgments of the National
Company Law Appellate Tribunal (NCLAT) as well as the
Adjudicating Authority. We concur with the view taken in
both the orders. Hence, there is no reason to entertain
the appeal.
Needless to add that if the appellant adopts remedies
for recovery, the same shall be decided on its own merits
without being influenced by the observations made in the
impugned orders.
Subject to what is observed above, the appeal is
dismissed.
Pending application(s), if any, shall stand disposed
of.
