Leave granted.

It is an admitted position that the Caste Scrutiny

Committee has rejected the caste claim of the first

respondent. Therefore, the order passed by the learned

Single Judge of reinstatement along with monetary benefits

which is confirmed by the Division Bench cannot be

sustained.

Accordingly, the impugned orders are set aside.

However, it will be open for the first respondent to

challenge the order passed by the Caste Scrutiny Committee

in accordance with law.

The Appeal is accordingly allowed.

Pending application(s), if any, shall stand disposed

of.
