O R D E R
Heard the learned counsel appearing for the appellant. After having perused the impugned judgment of the National
Company Law Appellate Tribunal (for short, “the NCLAT”), we find no error therein and we concur with the view taken by the NCLAT.
The learned senior counsel appearing for the respondent states that within a period of one week from today, a sum of Rs.55,23,253/- (Rupees Fifty-five Lakh Twenty-three Thousand Two Hundred and Fifty-three only) will be paid by the respondent to the appellant. The appellant will accept the amount without prejudice to its right to file appropriate proceedings for recovery of interest in accordance with law.
The Appeal is, accordingly, dismissed by taking the aforesaid statement of the respondent on record.
If the respondent fails to make payment in terms of its statement within a period of one week from today, it will be open for the appellant to apply for revival of this Appeal.
