IN THE SUPREME COURT OF INDIA CIVIL APPELLATE JURISDICTION

Civil Appeal No.14728/2024 [@ SPECIAL LEAVE PETITION (C) NO.27887/2023

STATE OF RAJASTHAN & ORS. Appellant(s)

VERSUS

CHORU LAL PRAJAPAT Respondent(s)

O R D E R

None for the respondent.

Leave granted.

After having heard the learned counsel appearing for

the appellant, we find no error in the view taken by the

learned Single Judge and the Division Bench of the High

Court. However, while passing the operative part of the

order, the learned Single Judge ought to have clarified

that the respondent will be entitled to increments in the

salary only from the date on which he passed BSTC.

Accordingly, we modify the impugned orders and direct

that the salary increment shall be payable to the

respondent from the date on which he passed BSTC.

2

The appeal is partly allowed on above terms.

Pending application(s), if any, shall stand disposed

of.
