UPON hearing the counsel the Court made the following O R D E R

1. Petitioners seek transfer of criminal proceedings under

section 138 of the Negotiable Instruments Act, 1881.

2. In view of the averments made in paragraph 6 of the

complaint (Annexure P/2), the Court at Calcutta would have

jurisdiction in light of the provisions of section 142(2)(a) of

the Negotiable Instruments Act, 1881.

3. The Transfer Petition is, therefore, dismissed.
