O R D E R
It is the contention of the appellant - M/s. Naroda Enviro
Projects Ltd. (CETP) that the appellant is compliant and not
liable.
At this stage, we are not inclined to interfere with the
impugned judgment, as it is open to the appellant – M/s. Naroda
Enviro Projects Ltd. (CETP) to raise all pleas and contentions
before the National Green Tribunal1, Western Zone Bench, Pune in
the pending Original Application no. 07 of 2020 (WZ).
We are confident the NGT will examine all pleas and
contentions before passing the final order.
It will be open to the appellant - M/s. Naroda Enviro
Projects Ltd. (CETP) to challenge the order dated 06.09.2023, if
required, after the NGT passes the final order.
The appeal is dismissed in the above terms.
Pending application(s), if any, shall stand disposed of.
