O R D E R
1 Leave granted.
2 The case of the prosecution is that an inferior coal has
been replaced at the instance of the accused including
the appellant to the value of around Rs.80,000/-
3 Considering the nature of the allegation, we are inclined
to grant anticipatory bail as the appellant has been
cooperating with the investigation, subject to the
conditions that he shall deposit the said sum of
Rs.81,000 on the file of the Trial Court without
prejudice to his contention.
4 Accordingly, the impugned order is set aside and the
appellant is granted anticipatory bail in the event of
arrest subject to the abovesaid condition and other

conditions that can be imposed by the Trial Court.
5 The appeal is allowed accordingly.
6 Pending application(s), if any, shall also stand disposed
of.
