IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTION
CRIMINAL APPEAL NO.______________/2024 (@ SPECIAL LEAVE PETITION (CRIMINAL) NOS. 14660/2024
MOHD. KHALID & ANR. Appellant(s)
VERSUS
THE STATE OF RAJASTHAN & ANR. Respondent(s)
O R D E R
1. Leave granted.
2. Heard learned counsel appearing for the appellants and
learned counsel appearing for the first respondent. Second
respondent is duly served.
3. In our view, by the impugned order dated 3rd
September, 2024, there was no reason for the High Court to
deny continuation of interim relief.
4. We, therefore, direct that interim order dated 24th
October, 2024 passed by this Court will continue till the
disposal of the pending Criminal Revision Petition
No.1193/2014 subject to the condition that the appellants
shall not seek adjournment on any unreasonable ground and
shall cooperate with the High Court for early disposal of
the revision petition. If it is found that the appellants
2
are delaying the proceedings, it will be open for the High
Court to discontinue the interim relief granted under this
order.
5. The appeal is accordingly allowed on above terms.
6. All contentions on merits of the Revision Petition are
left open to be decided by the High Court.
7. Pending application(s), if any, shall stand disposed
of.
