CIVIL ORIGINAL JURISDICTION

TRANSFER PETITION (CIVIL) NO.298/2024

FALGUNI PETITIONER

VERSUS

PARESH VINODBHAI PANCHAL RESPONDENT

O R D E R

1. This transfer petition has been filed by the petitioner-

wife. The petitioner-wife has filed an appeal under Section

28(1) of the Hindu Marriage Act, 1955 before the Additional

District Judge, Idar, Gujarat. The petitioner-wife prays that

the matter be transferred to the Family Court at Bandra,

Maharashtra.

2. As the divorce petition, of which the transfer petition is

filed by the petitioner, has already been decreed and the

petitioner has now filed an appeal before the Appellate Court

which is pending. At this stage, the transfer is being sought.

3. Under these circumstances, we are not inclined to accept

the prayer made in the present transfer petition and hence, the

same is dismissed.

4. However, the parties may be allowed to appear virtually,

unless their physical presence is required.

5. Pending application(s), if any, shall stand disposed
