Leave granted.

This   is   a   matter   relating   to   an   MACT   Claim.

Notices   were   issued   limited   to   consideration   of   the

reduction made by the High Court in the compensation

awarded by  the Tribunal   towards death of  deceased’s

son.

The   determination   made   by   the   MACT   was

Rs.3,51,000/­,   which   has   been   reduced   to

Rs.2,65,000/­, vide  impugned order dated 04.10.2021

passed by the High Court.

However,   there   is   no   determination   by   the

High   Court   on   facts   as   to   why   the   amount   has

been   reduced.     This   makes   this   determination

arbitrary   and   hence   violative   of   Article   14.     For

this reason, we allow the present appeals to the  limited

extent   that   the   claim  in   M.V.C. No.  1571  of  2011

is determined as what was fixed by the MACT i.e. at the
