O R D E R
We do not find any good ground or reason to interfere with
the impugned judgment, allowing the application filed the
respondent M/s Thaicom Public Company Limited under Section 60(5)
of the Insolvency and Bankruptcy Code, 20161, after referring to
Forms 3 and 5.
Accordingly, the present appeal is dismissed.
However, we clarify that the impugned judgment and the
dismissal of the present appeal will not be construed as an
expression of opinion on whether the petition under Section 9 of
the IBC is within time.
It will be open to the appellant – M/s. Raj Television
Network Limited to move an application for filing an additional
written statement in view of the amendment allowed by the National
Company Law Appellate Tribunal, Chennai Bench. Any such application
filed will be considered and decided in accordance with law. We
express no opinion in this regard.
