Leave granted.
We have heard learned senior counsel for the
appellant and learned counsel appearing for respondent
nos. 1 and 2.
During the course of submissions, learned senior
counsel for the appellant drew our attention to the
order dated 24.09.2024 passed by this Court in
Special Leave Petition (Crl.) No. 1041/2024
(Sanjay Vs. the State of Uttar Pradesh & Anr.)
arising out of the same FIR.
She submitted that having regard to said order,
a similar order may be made in this case also as the
respondent/accused has been named in the Charge Sheet
dated 19.09.2023 filed in FIR No.193/2023.

Learned counsel for the respondent/State also
endorsed the submissions made by learned senior
counsel for the appellant.
Learned counsel for respondent no.2 however
contended that the case alleged against the
respondent/accused cannot be on the same footing as
that of the other accused. She, therefore, submitted
that the order of this Court in the case of Sanjay
Vs. the State Of Uttar Pradesh & Anr. may not apply
in the instant case.
