IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTION
CRIMINAL APPEAL NO. 5173 OF 2024 (@ SLP(CRL.) No. 15860/2023)
SURAJ APPELLANT(S)
VERSUS
THE STATE OF MADHYA PRADESH & ANR. RESPONDENT(S)
WITH
CRIMINAL APPEAL NO. 5174 OF 2024 (@ SLP(Crl) No. 16115/2023)
O R D E R
1. Leave granted.
2. The present appeals have been filed by the appellants,
aggrieved by the cancellation of bail at the instance of
the informant - father of the victim.
3. We find that the suspension of sentence was granted by the
High Court in the year 2013 and the same has been
cancelled in the impugned order, based on certain
occurrences alleged to have happened in 2016 and between
the years 2020-23, pertaining to which one/both of the
appellants have been arrayed as accused. Except one or
two, most of the offences are non-cognizable in nature.
There is also a counter case given at the instance of the
appellants’ side.
4. In such view of the matter, we are inclined to set aside
the impugned order and restore the suspension of sentence
2
granted earlier.
5. We have been informed that the criminal appeal is of the
year 2013. Thus, we request the High Court to make an
endeavour to dispose of Criminal Appeal No.175/2013
expeditiously, preferably within a period of six months
from today.
6. The appeals are allowed, accordingly.
