O R D E R
1. Leave granted.
2. Heard learned counsel appearing for the parties.
3. The appellant is undergoing fixed term sentence of 10
years. He has undergone incarceration for a period of
about 5 years and 10 months. The appeal is of the year
2024 and is not likely to be heard in near future.
Therefore, the High Court ought to have granted benefit of
suspension of sentence and bail to the appellant.
Accordingly, the impugned judgment and order is set aside.
4. We direct that the appellant shall be produced before
the Trial Court within a maximum period of one week from
today. The Trial Court shall enlarge the appellant on bail
on appropriate terms and conditions till the disposal of
the appeal before the High Court. The respondent shall be

heard before fixing the terms and conditions.
5. The appeal is accordingly allowed.
6. Pending applications stand disposed of.
