O R D E R
Heard the learned counsel appearing for the parties.
Leave granted.
The appellant is being prosecuted for the offences punishable
under Sections 3 and 4 of the Prevention of Money-laundering Act,
2002 (for short, “the PMLA”).
Perused the counter affidavit filed by the respondent.
Considering the allegations against the appellant, which are
stated in paragraph 17 of the counter affidavit, it is very
difficult to attribute any direct role, as of today, to the
appellant for the offence under the PMLA.
The appellant will be entitled to bail by the reason of parity
with co-accused (Harish Yadav) who was granted bail by this Court
vide order dated 30th August, 20241.
Accordingly, we direct that the appellant shall be produced
before the Special Court within a period of one week from today.
The Special Court shall enlarge the appellant on bail on
appropriate terms and conditions. The respondent shall be heard
before fixing the terms and conditions.
