1. Leave granted.
2. Heard Mr. Kartikeya Bhargava, learned counsel appearing for
the appellant. Also heard Dr. Vijendra Singh, learned counsel
appearing for the respondent No. 2 – State of Uttar Pradesh. The
respondent No. 1, although served, as can be seen from the office
report dated 07.12.2024, has failed to enter appearance.
3. The State has supported this appeal by the victim’s mother,
for cancelling the bail for the respondent No. 1. The State’s
counsel submits that the accused had the lead role in the crime and
he also fired upon the police team, when he was being arrested.
4. Notice in this case was issued on 22.10.2024 with the
following order:
1. Permission to file Special Leave Petition is granted.
2. Heard Mr. Kartikeya Bhargava, learned counsel appearing for the petitioner.
3. The challenge here is to the bail granted in favour of Sukhmeet (respondent No. 1/Accused No. 2), who has 11 criminal antecedents including a case pertaining to firing on policeman at the time of his arrest. However, ignoring the criminal antecedents, bail was granted to
