O R D E R
1. Leave granted.
2. The appellant is aggrieved by the interim
order dated 20/06/2025 passed by the High Court
of Madhya Pradesh at Gwalior in IA No.17569 of
2023 in CRA No.12081 of 2023.
3. By the said order, the High Court refused to

suspend the sentence imposed upon the
appellant, vide judgment dated 31/08/2023
passed by the learned Special Judge, Prevention
of Corruption Act, Morena, Madhya Pradesh, in
SC No. 03 of 2016, and release him on bail
pending consideration of his appeal.
4. Mr. Nishant Katneshwarkar, learned counsel,
appearing for the Special Police Establishment
(Lokayukt) Organization, opposes the grant of
relief but admits that the appellant has
completed more than 50% of the sentence imposed
upon him.
5. Considering the fact that the offences for
which the appellant stands convicted are not
heinous in nature and as he has already
completed more than 50% of the sentence visited
upon him, we are of the opinion that he would
be entitled to relief at this stage. More so,
as his appeal is of the year 2023 and there is

no possibility of the same being heard any time
in the near future.
