IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTION
CRIMINAL APPEAL NO. OF 2024 (@ SLP(CRL.) No. 233/2024)
SUSHIL KUMAR BARNWAL & ORS. APPELLANT(S)
VERSUS
THE STATE OF JHARKHAND & ANR. RESPONDENT(S)
O R D E R
1. Leave granted.
2. We are not inclined to interfere with the impugned
judgment insofar as the appellant No.1 is concerned, since
we find that the relevant contentions raised would have to
be decided at the time of trial. However, we find force in
the submissions made by learned counsel appearing for the
appellants, and for the remaining appellants that there is
no adequate material to implicate them. They are merely
the parents of the appellant No.1.
3. In such view of the matter, the continuation of the trial
as against these persons would amount to a travesty of
justice.
4. Accordingly, the proceedings stand quashed insofar as
2
appellant Nos.2 to 3 are concerned.
5. The appeal is allowed in part.
6. Pending application(s), if any, shall stand disposed of.
