Leave granted.

In our opinion, respondent No. 7, M/s. Third Eye Security

Services Pvt. Ltd., was not eligible in view of Rule 111 of the

Madhya Pradesh Private Security Agencies Rules, 20122. Under the

said rule, there is no deemed renewal when an application for

renewal is pending.

Reliance was placed in the impugned judgment on the model

rules framed by the Central Government, Ministry of Home Affairs,

namely, the Private Security Agencies Central Model Rules, 20203,

which, at the relevant time, had not been adopted by the State of

Madhya Pradesh. Then, the State Rules, 2012 were applicable.

Section 244 of the Private Security Agencies (Regulation) Act,
