O R D E R
1. Mr. Manish Singhvi, the learned Senior counsel appearing for
the State of Himachal Pradesh makes a statement that in pursuance
of the order passed by this Court, the entire amount has been paid
by the State to the land owners.
2. We have already made ourselves clear in our judgment that it
will be open for the State to recover the amount from M/s.
Jaiprakash Associates Limited, Noida, U.P. in accordance with law.
3. We were left with no other option but to direct the State to
make the payment considering the peculiar facts and circumstances
of this case and, therefore, our directions to the State to make
the payment, shall not be treated as a precedent.
4. Miscellaneous Application stands disposed of in the above
