Leave granted.
We have heard learned counsel for the parties.
It is apparent that there is dispute inter se the two
brothers, which has led to a number of litigations including
criminal cases. As per the appellants – Siddharth Mukesh Bhandari
and Harendrasingh Diwan Bisht, there is a management dispute. This
is disputed by the learned Senior Advocate appearing for the
informant/complainant. However, it is accepted that there are
pending litigations relating to control and management of the
company.
The appellants - Siddharth Mukesh Bhandari and Harendrasingh
Diwan Bisht have been in custody for about 81 days.
Having regard to the facts and circumstances of the case, we
are of the opinion that the appellants – Siddharth Mukesh Bhandari
Crl.A. @ SLP(Crl.) No. 14558/2023 1
and Harendrasingh Diwan Bisht should be released on bail in First
Information Report (FIR) no. 11201001230007/2023 dated 21.09.2023
registered with Police Station – CID Crime, Gandhinagar Zone,
District – Gandhinagar, Gujarat for the offence(s) punishable under
Sections 143, 15...
