STATE OF ORISSA Respondent(s)

O R D E R

Leave granted.

The appellant is charged under Section

20(b)(ii)(C) and Section 25 of the Narcotic Drugs and

Psychotropic Substances Act, 1985,

It is submitted that the appellant has already

undergone one year and seven months’ incarceration.

Only six out of 18 witnesses have been examined.

There are no prior criminal antecedents in which the

appellant is said to be involved.

Taking into consideration the period of

incarceration and that the trial is likely to take

some time to conclude, we are inclined to grant bail

to the appellant.

Accordingly, the impugned order is set aside and

the appellant is granted bail on terms and conditions

to the satisfaction of the trial Court.
