Leave granted.
After having found that the respondent was
dispossessed from the land without following the
due procedure established by law, the High Court
has applied the provisions of the Right to Fair
Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act, 2013 (in short
‘2013 Act’) for the purpose of computation of
compensation to be paid to the respondent.

Aggrieved by the same, the present appeal has
been filed by the appellants.
Learned senior counsel appearing for the
appellant vehemently contended that even assuming
that the findings of fact are correct, the
application of the 2013 Act cannot be accepted in
the absence of any legal sanction.
Considering the said submission and after
finding that the said submission merits acceptance,
we put to the learned counsel appearing for the
respondent as to whether the order can be modified
to the effect that from the date of resumption of
the land, the benefit under the Land Acquisition
Act, 1894 (in short ‘1894 Act’) can be applied.
