1. Leave granted.
2. The order under challenge is the order dated
22.08.2023 passed by the High Court of Punjab and Haryana
at Chandigarh in CRM-M No.23903 of 2018, whereby the High
court has allowed the said petition and quashed the
F.I.R. being No.3 dated 10.01.2016 registered against the
respondent No.1 – accused as also the other consequential
proceedings arising therefrom.
3. It is sought to be submitted by the learned counsel
for the appellant – complainant that though the Charge
Sheet against the respondent No.1 – accused was filed on
23.10.2016, the charge was framed by the Trial Court on
23.04.2018 and the petition for quashing was filed by the
respondent No.1 before the High Court on 28.05.2018, the
respondent No.1 had suppressed the material facts and
sought quashing of the F.I.R. He further submitted that
it was the State, which had filed the reply and stated

about the filing of the Charge Sheet and framing of the
charge against the respondent No.1.
