Heard the learned counsel appearing for the parties.
Leave granted.
The appellant has undergone incarceration for a period of five
years and more. The learned counsel appearing for the
respondent/State stated that the State wishes to examine 25
witnesses. But so far, only 06 witnesses have been examined.
Thus, the trial is not likely to conclude in near future. Hence, a
case is made out for enlarging the appellant on bail.
For that purpose, we direct that the appellant shall be
produced before the Trial Court within a period of one week from
today. The Trial Court shall enlarge the appellant on bail on
appropriate terms and conditions.
The Appeal is, accordingly, allowed.
