Heard the learned counsel appearing for the parties.
When we made a query to the learned counsel appearing for the
State whether the investigating officer called the appellant for
investigation any time after 23rd October, 2024, the learned counsel
accepted that after 23rd October, 2024, the investigating officer
has not called the appellant for investigation. Thus, for a period
of about two months, the presence of the appellant for
investigation was not required.
Hence, the interim order dated 23rd October, 2024 is made
absolute on the same terms and conditions.
The Appeal is, accordingly, allowed.
