Leave granted.

Heard Mr. Shoeb Alam, learned senior counsel

appearing for the appellant and learned Solicitor

General appearing for the respondent-State.

Learned senior counsel appearing for the

appellant at the very outset submits that he would

not be pressing any argument with regard to non-

compliance of Section 52-A of the Narcotic Drugs

and Psychotropic Substances, Act, 1985.

The appellant is in custody since 17.09.2021

i.e. for a period of over three years in connection

with the NDPS Case pursuant to F.I.R. No.83 of 2021

dated 17.09.2021, registered with Anti Narcotic

Cell, Ghatkopar Unit, Mumbai whereunder a

contraband article i.e. Codeine and

Chlorpheniramine mixed with cough syrup was

recovered from the appellant.

Charge sheet has been submitted on

17.03.2022 but till date, charges have not been

framed meaning thereby, the trial is not likely to

be commenced/completed in the near future.

In view of the aforesaid facts and

circumstances of the case, we deem it proper to

enlarge the appellant on bail. Accordingly, we

direct that the appellant be released on bail

subject to the terms and conditions as may be
