O R D E R
1. Leave granted.
2. Heard learned Senior counsel appearing for the
appellant and learned A.S.G. appearing for the respondent.
3. The appellant has undergone incarceration for a period
of about one year and five months for the offence
punishable under Section 4 of the Prevention of Money
Laundering Act, 2002 (PMLA). The charge is not yet framed.
There is no possibility of trial commencing within
reasonable time. Hence, following the principles laid down
in paragraphs 26 to 28 of the decision of this Court in the
case of V. Senthil Balaji versus The Deputy Director,
Directorate of Enforcement, [2024 INSC 739], the appellant
is entitled to be enlarged on bail.
4. For that purpose, we direct that the appellant shall

be produced before the Special Court within a maximum
period of one week from today. The Special Court shall
enlarge the appellant on bail pending the trial on
appropriate stringent terms and conditions. The learned
counsel appearing for the Enforcement Directorate shall be
heard on terms and conditions.
