O R D E R

1. Leave granted.

2. The appellants - Shanmugam and Masure have been convicted

under the provisions of the Prevention of Corruption Act,

1988 as well as under the provisions of the Indian Penal

Code, 1860. Whereas, the appellant – Hashim has been

convicted for the offence punishable under Sections 120B,

420, 468 and 471 of the Indian Penal Code, 1860 alone.

3. The case against the appellants is that they were jointly

involved with respect to fabrication of the document by

way of committing cheating, which ultimately led to the

loss of around Rs.8 Lakhs to be suffered by M/s Engine

Factory, Avadi, Ministry of Defence, Chennai, Central

Government.

4. We had issued a limited notice only with respect to the

quantum of sentence alone.

5. We have perused the evidence available on record, and the

conviction rendered by both the Courts does not warrant

any interference, as the evidences have been rightly taken

into consideration for rendering the conviction.
