O R D E R

1.   The  petitioner  has   filed   this  Transfer  Petition  seeking

transfer of Compliant Case bearing CC No.102645 of 2022

titled as “Kotak Mahindra Bank Ltd. vs. Elain Jean Robins

@Elain   Matthew”   from   the   Court   of   Additional   Chief

Metropolitan   Magistrate,   Ahmedabad   City,   Gujarat   to   the

Court of Chief Metropolitan Magistrate, South­West District,

Dwarka Courts, Delhi.

2. Despite service of notice on the respondent – Bank, no

one   has   entered   appearance   to   contest   the  matter   on   its

behalf.  We have heard learned counsel for the petitioner.

3.   Although   the   petitioner   does   not   deny   that   she   had

given   a   cheque   to   the   respondent   –   Bank,   which   was

subsequently dishonoured and now a case has been initiated

her under Section 138 of the Negotiable Instruments Act, but

she expresses hardship in contesting the case at Ahmedabad,

Gujarat, where it is filed.
