Leave granted.

Heard learned counsel appearing for the

appellant and learned counsel appearing for the

respondent-State and perused the materials placed

on record.

The appellant is suffering incarceration

from 09.01.2024 and is aged about 61 years. The

trial is at the nascent stage and is not likely to

be completed in the near future.

In view of the aforesaid facts and

circumstances of the case, we deem it appropriate

to enlarge the appellant on bail. Accordingly, we

set aside the impugned order and direct that the

appellant be released on bail subject to the terms

and conditions as may be imposed by the Trial

Court.

The present appeal is allowed in the above
