1. Delay condoned.
2. We have heard Mr. Sumit Kumar, learned counsel for the
applicant/appellant as well as Major Priyank Malviya for the
respondent.
3. It seems to us that a part of cause of action arose
within the jurisdiction of the High Court of Delhi. Therefore, this
Court while relegating the applicant/appellant to approach the High
Court, specifically mentioned that he shall be at liberty to
approach the jurisdictional High Court or High Court of Delhi.
Since the applicant/appellant, keeping in view his other mitigating
circumstances, wants to continue the proceedings before the High
Court of Delhi, we clarify our order dated 16.02.2024 to the extent
that let the applicant’s claim be decided by the High Court of
Delhi on merits.
4. M.A. stands disposed of accordingly.
5. As a result, the pending interlocutory application(s)
also stand disposed of.
