1. Leave granted.
2. Heard learned senior counsel/counsel for the parties.
3. The appellant was convicted and sentenced for life
imprisonment by the Sessions Judge, Patiala House Courts, New
Delhi for the offences punishable under Sections 376(2)(f),
376(2)(n) and 506 of the Indian Penal Code which has been upheld
by the High Court. The allegations against the appellant, who is
the step-father of the prosecutrix/victim, is that he had
continuously raped the victim, for eight long years. In 2015,
when prosecutrix/victim had filed the FIR, she was about 30 years
of age and therefore the case of the appellant before this Court
is that it is not the case where there is a rape of a minor.
Moreover, it has also been said that there is no complaint or FIR
at any point of time but in the year 2015 when prosecutrix/victim
was thrown out of the house by the appellant. On the other hand,
the prosecution has alleged that the prosecutrix/victim has two
female children and appellant is the biological father of those
children.
