1. Leave granted.
2. The Appellant before us was the original Complainant
before the Trial Court, while the Respondents were
the Accused. Despite service of notice by both routine
methods and by substituted service, no one has
appeared on behalf of the Respondents.
3. The present appeal arises out of the judgment and
order dated 22.10.2021 passed by the High Court of
Judicature at Madras, dismissing the Appellant’s
Criminal Appeal and thereby affirming the judgment
of the Sessions Court dated 08.01.2015. By the said
judgment, the Sessions Court had set aside the
conviction and sentence recorded by the Trial Court

on 30.10.2012 in C.C. No. 3023 of 2010. In its
judgment dated 30.10.2012, the Trial Court had
convicted the Respondents under Section 138 of the
Negotiable Instruments Act, 1881 (“N.I. Act”) and
sentenced them accordingly. Aggrieved by the orders
of the Sessions Court and the High Court, the
Appellant now approaches this Court.
4. Briefly stated, the facts are as follows: On
22.07.2009, the Appellant (original Complainant)
