Leave granted.
Heard learned senior counsel appearing for the
appellant as well as learned counsel appearing for
the respondents.
A notification was issued way back in the year
1988 which has not attained its finality,
notwithstanding the challenges made at different
points in time.

The respondent(s) earlier filed a writ
petition challenging the acquisition under Section
11A of the Land Acquisition Act, 1894 (in short,
the ‘1894 Act’) on the ground that the award has
not been passed within the time period of two
years. This petition was dismissed by the High
Court, inter alia, holding that the award was
passed within the time period. Then, the
respondent(s) sought a remedy under Section 48-B of
the 1894 Act which was rejected by the Government.
Challenging the rejection order, another writ
petition was filed by the respondent(s) which was
also dismissed. Thereafter, another writ petition
was filed after the disposal of the earlier writ
petition, on the new ground as prior approval under
Section 11A of the Act was not obtained, which was
surprisingly...
