Heard the learned counsel appearing for the parties.
Leave granted.
The First Information Report has been registered on
15th September, 2020 for the offences punishable under Sections 406
and 420 read with Section 34 of the Indian Penal Code, 1860. For
four long years, the Police have not completed the investigation.
On a query made by the Court, the learned counsel appearing for the
State accepted that after 5th September, 2024, the appellants have
appeared for investigation.
The case is substantially based on documentary evidence. In
any case, the criminal proceedings cannot be converted by the first
informant/Bank into the recovery proceedings.
Hence, the interim order dated 5th September, 2024 is made
absolute on the same terms and conditions.
The Appeal is, accordingly, allowed.
