IN THE SUPREME COURT OF INDIA CRIMINAL ORIGINAL JURISDICTION
TRANSFER PETITION (CRIMINAL) NOs.879-880/2024
SAVITA GUPTA @ SAVITA AGGARWAL PETITIONER(S)
VERSUS
AMIT AGGARWAL & ORS. RESPONDENT(S)
ORDER
Heard learned counsel for the petitioner and
the learned counsel appearing for the respondents.
The petitioner-wife is seeking transfer of
two cases, first being a complaint case and the
second being a case for maintenance filed under
Section 125 of the Code of Criminal Procedure,
which have been instituted by the petitioner
herself at the place of her choice i.e. Hathras,
Uttar Pradesh to Karkardooma Court, East District,
New Delhi.
Merely for the reason that she has shifted
her residence, is not a good ground to get the
cases transferred.
In view of the aforesaid facts and
circumstances of the case, we do not find any
substance in the present transfer petitions and the
same are, accordingly, dismissed with liberty to
the petitioner to appear, if necessary, through
2
virtual mode, subject to the permission of the
concerned Court.
Pending application(s), if any, shall stand
disposed of.
