O R D E R
1. By way of this petition, filed under Section 25
of the Code of Civil Procedure, the petitioner-wife is
seeking transfer of the Matrimonial Case No. 391/2023,
titled “MD. NAZIM Vs. SHABNAM KHATUN” from the Court of
Principal Judge, Family Court, Muzafarpur, Bihar to the
Family Court, Dwarka, Delhi.
2. Earlier, on 13.11.2024, the respondent-husband
did not enter his appearance, though duly served, and
this Court, by way of last opportunity, granted him
time of four weeks to enter his appearance. Even today,
when the matter is called out, none is present for the
respondent. Hence, it appears that the sole-respondent
has no objection if the present petition is
transferred, as prayed for.
3. Under these circumstances, heard learned counsel

appearing for the petitioner.
4. As per the facts of the case, and even otherwise
also, the petitioner has made out a ground for transfer
of the present petition and accordingly, the same is
allowed.
5. Accordingly, as prayed for, Matrimonial Case No.
391/2023, titled “MD. NAZIM Vs. SHABNAM KHATUN” is
directed to be transferred from the Court of Principal
Judge, Family Court, Muzafarpur, Bihar to th...
