1. Delay condoned.

2. Leave granted.

3. This appeal is against the order of the High Court of

Himachal Pradesh at Shimla dated 04-08-2023 by which the

appellant’ prayer for suspension of sentence has been rejected

in CRLMP No.2334/2023 in Criminal Appeal No.32 of 2023.

4. Heard the learned counsel appearing for the appellant as

also the learned counsel for the respondent-State.

5. In view of the fact that the appellant has already

undergone incarceration of approximately eight years and there

is no possibility of the appeal to be taken up immediately, we

suspend the sentence and enlarge the appellant on bail subject

to such conditions as the Trial Court may impose.

6. The appeal is allowed.
