Leave granted.
The appellant, Rahul Rahaman, is
aggrieved by the judgment and final order
dated 21.05.2025 passed by the High Court
at Calcutta Circuit Bench at Jalpaiguri in
CRM (NDPS) No. 4/2025, denying him regular
bail. The matter arises under the
provisions of the Narcotic Drugs and

Psychotropic Substances Act, 19851, in
connection with Complaint No.
03/NCB/SLG/2024 dated 30.05.2024 for the
offences punishable under Sections 21(c),
25 and 29 of the Act of 1985.
The appellant, Rahul Rahaman, is
alleged to have been involved in the
trafficking of Phensedyl Cough Syrup,
containing ‘Codeine Phosphate’, which
would come within the ambit of the
provisions of the Act of 1985.
However, we are informed that the
seizure of the contraband, viz., 16549
bottles of Phensedyl Cough Syrup, was
effected without video recording of such
seizure. This was not in keeping with the
directions of the High Court at Calcutta
in its order dated 22.06.2022 passed in
C.R.M. (NDPS) No. 492/2022, titled “Kalu
Sk. @ Kuran vs. State” and C.R.M. (NDPS)
No. 493/2022, which required that such
