O R D E R

1. Heard learned counsel for the parties.

2. The petitioner-wife is seeking transfer of H.M.O.P. No. 100

of 2022 titled “Yanamala Rajasekhar Vs. Rapani Anitha @ Yanamala

Anitha” from the Court of learned Senior Civil Judge, Kandukur,

District Nellore, Andhra Pradesh to the Family Court at

Nizamabad, State of Telangana.

3. It is submitted by learned counsel for the petitioner that

another case under section 498(A), IPC against the respondent is

already pending before the Third Additional JMFC (Special Mobile

Court) at Nizamabad, Telangana.

4. Taking into consideration the facts and circumstances of

the case, H.M.O.P. No. 100 of 2022 titled “Yanamala Rajasekhar

Vs. Rapani Anitha @ Yanamala Anitha” pending before the Court of

learned Senior Civil Judge, Kandukur, District Nellore, Andhra

Pradesh is transferred to the Family Court at Nizamabad, State

of Telangana.

5. The transferor Court shall forthwith transmit the entire

record relating to the aforesaid case to the transferee Court

for deciding the case in accordance with law.

6. Further, in the facts of the present case, we grant liberty

to the respondent to make an appropriate application before the

transfer...
